2025 Annual Meeting Recap, Election Results & Clarification

Thank you all again for participating in this year’s annual meeting.
Congratulations again to Mr. James Williams.. Mr. Williams joins Tammy Whittington and Danny Rawls on the board.
The final tally of the election is as follows:

In addition, we want to help bring some resolve and understanding to some of the comments and direction posted on the social media accounts. We have provided feedback on some of the statements made and have provided reference points for everyone to further review:
1. Statement : Section 209.0050 of the property code clearly states the ACC member must step down BEFORE a spouse or family member runs for the board
Answer: There is not a section 209.0050 in property Code. The closest area is Section 209.005- Association Records:

In 2025, the 89th Legislature confirmed a bill (SB711) which supplemented property code. The sections are 209.00506 and 209.00507. Section 209.00506 provides guidance for the authority of the architectural control committee and how the board interacts when a decision is denied such by the ACC committee. Section 209.00507 defines the solicitation process for candidates for the architectural control committee where there is a vacancy on the committee.
2. Statement: Section 209 0050 of the property code clearly states the ACC member must step down BEFORE a spouse or family member runs for the board. Not just once but 3 times, and also 4.7 you referenced to one owner mentioned it
Answer: Incorrect. Guidance is provided above concerning section 209.0050 legitimacy. Section 4.7 is in the community Bylaws and does not provide direction on the ACC and board position determination. Section 4.7 provides the quorum requirements specific to Star Mountain POA. You can find your Bylaws under Documents/ Governing Documents.

3. Statement: Also other home owners informed me today that mitch winn stepped down prior to his term ending, why wasn't home owners notified and a meeting called to elect an interm till the 11th of November.
Answer: Mitch Winn did not step down prior to his term ending. He decided not to run again. If a board member resigns before the end of their term. Section 5.1 and Section 5.5 provide guidance on next steps. The board may be filled by a majority of the remaining Board members. If the board were to decide to hold a meeting to replace the vacated seat, a meeting will be called, agenda generated with the line item “Board Interim Placement- Discussion and Vote” The meeting would be held open to the membership of the neighborhood and the BOARD would motion and approve the interim appointment with the interim completing the vacated term. When the term is up, the seat would then be voted on by the membership. Currently, the Board is not required to fill the vacancy . The note section states “May.”

4. Statement/ Question: . I believe TX law requires a property owner's association to be 20% of the voting members in person or by proxy to reach a quorum to vote on board members. Further, I believe that the association has 160 owners, so a quorum would be 32 voting members. Is that accurate? The total number of votes was 32 or greater?
Response/ Answer: All the voting follows Sec 4.7 of the bylaws to ensure quorum (Please review above) The ballots received during the meeting and prior via absentee ballot met the quorum requirements of the community. To ensure business can be conducted at the annual meeting , your community utilizes the ability to vote via absentee (not able to be present) . Per Texas property Code Section 209.0058 and Section 209.00592 which states “The voting rights of an owner may be cast or given: 1. In person or by proxy at a meeting of the property owners association. 2. By absentee ballot 3 by electronic ballot An absentee or electronic ballot may be counted as an owner present and voting for the purpose of establishing quorum only for the items on the ballot.
